MVD Violation Clarification

Arizona has once again changed its DUI laws.  The new law goes into effect December 31st of 2011.  Only people who are convicted of a DUI on or after December 31st 2011 and ordered to have an ignition interlock installed fall under the new law.

Current Law all people who are over 21 and have been convicted of a DUI or Extreme DUI must have an interlock for 12 months.  IF the person violates they will receive an additional 12 month extension of the interlock requirement.

What is a violation?

For persons who are 21 years of age or older
Any attempt to start the vehicle with a BAC (Breath Alcohol Concentration) of a .08 or greater three (3) times during the 12 month period is a violation and will result in an additional year of the interlock

Any (1) one time that you miss a random rolling retest is a violation and will result in an additional year of the interlock for any ONE TIME MISSED

Any (1) one time that you start your car without providing a breath sample (jump start, disconnect the interlock) is a violation and will result in an additional year of the interlock

For persons who are under 21 years of age when ordered to have the interlock
Any attempt to start the vehicle with a BAC (Breath Alcohol Concentration) of a .04 or greater (1) one time during the 12 month period is a violation and will result in an additional year of the interlock
